Councillor Kosovic will be returning to his duties as a member of the Village of Clinton Council following a mandatory paid leave of absence. Councillor Kosovic notified the Village of pending criminal charges on May 23, 2024 and was immediately placed on a leave under section 109.3 of the Community Charter. The Village was not party to the legal proceedings.
As Councillor Kosovic’s court proceedings have concluded without a conviction for an indictable offence, he is eligible to return to his position and has regained the powers, duties, and functions of an elected Councillor. Although Councillor Kosovic was found guilty of an offence under summary conviction, this does not result in disqualification from holding office under the Local Government Act. His leave of absence ends May 28, 2025.
The Village is required to manage criminal charges and the resulting leave of absence in accordance with the Community Charter and the Local Government Act. Under the Local Government Act, a Council member is disqualified from holding office if they are convicted of an indictable offence. No by-election is required at this time and the next general local election is planned for October 2026.
Reinstatement of Councillor Kosovic’s committee appointments will be considered at a future council meeting.
